Advance directives are certain documents that provide for the appointment of an agent for financial and health care matters.  The primary documents are the Power of Attorney, Health Care Proxy and Living Will.  There are other documents that cover other important areas including granting authorization to obtain protected health care information and disposition of remains.

Absent these documents being in place, a lengthy and expensive guardianship would likely be necessary to acquire the necessary powers to conduct affairs.   As such, it is very important that clients review their current documents to ensure they are in place, properly drafted to cover all necessary powers and contingencies, and are updated if necessary.
